Start with the exact document
Ask your accountant, tax adviser or lawyer to identify what has actually been issued, the date it was served and the relevant deadline. Do not rely on a verbal description such as “ATO notice”.
Director penalty notices
The ATO states that directors can become personally liable for unpaid PAYG withholding, GST and super guarantee charge. The consequences and available responses can depend on the liability, reporting history and timing, so directors should obtain professional advice immediately.
Statutory demands
The ATO says it may issue a statutory demand requiring a company to pay the debt or enter an acceptable payment plan within 21 days. Failure to comply can be relied on as evidence of insolvency in a winding-up application.
Funding is not a substitute for legal action
A future commercial facility may be relevant to a viable business's broader restructuring plan, but it does not suspend a statutory deadline, guarantee the ATO will accept an arrangement, or determine whether a company is solvent.
